The Pre-Conception and pre-natal Diagnostic Techniques (Prohibition of Sex Selection Act) 1994 Amendment Act, 2003

An Act to provide for the prohibition of sex selection, before or after conception, and for regulation of pre-natal diagnostic techniques for the purposes of detecting genetic abnormalities or metabolic disorders or chromosomal abnormalities or certain congenital malformations or sex linked disorders and for prevention of their misuse for sex determination leading to female foeticide and for matters connected therewith or incidental there to.

  1. Prohibition of the misuse of Pre-natal diagnostics techniques for determination of sex of foetus, leading to female foeticide,
  2. Prohibition of advertisement of pre- natal diagnostic techniques for detection or determination of sex.
  3. Permission and regulation of the use of pre-natal diagnostic techniques for the purpose of detection of specific genetic abnormalities or disorders.
  4. Permitting the use of such techniques only under certain conditions by the registered institutions.

Punishment for violation of the provision of the proposed legislation.

  1. Act seeks to prohibit pre-natal diagnostic techniques for determination of sex of the foetus leading to female feticides
  2. The pre-natal diagnostic techniques like amniocentesis and sonography are useful for detection of genetic or chromosomal disorders or certain congenital malformations or sex linked disorders etc, however the amniocentesis and sonography are being on a large scale to detect the sex of the foetus and to terminate the pregnancy of the unborn child if found to be female.
  3. The proliferation of the technologies mentioned above may, in further, precipitate a catastrophe in the form of severe imbalance in male female ratio.

Accordingly, it is proposed to amend the aforesaid Act either a view to banning the use of both sex selection techniques prior to conception as well as the misuse of pre-natal diagnostic techniques for sex selection abortions and to regulate such techniques with a view to ensure their scientific use for which they are intended.

The Pre-Conception and pre-natal Diagnostic Techniques (Prohibition of Sex Selection Act) 1994 Amendment Act, 2003 and updated in Section 17 has been formed under the Advisory Committee Pune Municipal Corporation. The Hon. Advisory Committee meetings are held on a regular basis. Hon. The Advisory Committee discusses the registration and renewal of sonography centers. and various letters received from State Government. Advisory Committee shall consist of, three medical experts from amongst gynecologists, obstetricians, pediatricians and medical geneticists, one Legal expert, one officer to represent the department dealing with information and publicity, three eminent social workers.

Vigilance Committee, of The Pre-Conception and pre-natal Diagnostic Techniques (Prohibition of Sex Selection Act) 1994 Amendment Act, 2003 consist of following members Hon. Municipal Commissioner is the Chairman, Assistant medical officer and Appropriate Authority, PCPNDT Act is Member Secretary, Chairman of the Advisory Committee, PCPNDT Act, PMC, Chief legal officer, Chief Accountant officer, PMC, The police commissioner (Pune City)Chief Education officer, President / representative of the Indian Medical Association (Pune Branch) and Pune Municipal Corporation medical officer(PCPNDT Cell), Information and public relations officer and Zonal medical officer is a member of the committee.

Steps taken to enforce PCPNDT Act

  • All sonography centres are registered in Pune Municipal Corporation. Total no. of registered sonography centres are 808 (Active 451).
  • All these centres are examined & inspected by respective Medical officer of PCPNDT Cell And Food Inspector in every quarter of the year.
  • Till now 63 court cases have been lodged against the sonography centres.for violation of act since year 2002.
  • Toll Free Helpline 1800-233-6099 for complaint of PCPNDT Act Violation.
  • Constitution of Special Cell :- A Special Cell is constituted under supervision of the Commissioner of Municipal Corporation, for effective implementation of PCPNDT Act.
  • Registration of PCPNDT Centre.
  • Registration of PCPNDT Centre done under section 3 and rule No. 4 of PCPNDT Act. There are basically 4 categories.

            1. Genetic Counseling Centre.

            2. Genetic Laboratory

            3. Genetic clinic

             4. Ultrasound clinic or Imaging Centre.

  • Fees for each one of above is Rs. 25,000/-
  • For providing joint services of above the fees are Rs. 35,000/-
  • Form “A” for application of registration to be submitted in duplicate.
  • Form is to be submitted in duplicate along with prescribed for of Rs. 25,000/- or Rs. 35,000/-

Papers to be submitted with Form “A” are

  1. Application (A Form-2 Copies)(Should be filled in Capital Letters)
  2. Commercial Property Tax Invoice of Assessment year with paid Receipt.
  3. Sanctioned plan of Place(showing measurement & Location of clinic- (3 Copies Blue Print) Completion / occupation certificate from PMC building permission dept.
  4. If Society/Trust, Registration Certificate from Competent Authority .
  5. Quotation of Machine/Performa/Invoice from authorized dealer/ Manufacture.
  6. Affidavit/ undertaking as per rules 4 (i) i & ii Shall not conduct any test or procedure for selection of sex before or after conception or for detection of sex of foetus nor shall sex of foetus be disclosed except for the diseases specified in section 4 Notarized Affidavit containing undertaking on Rs100 stamp paper.
    A) From owner/Applicant
    B) From each and every person Operating USG Machine.
  7. Notarized Affidavit from applicant that he/she not facing any criminal case under PCPNDT act.
  8. Xerox Copy/copies of Educational Qualification

  1. Appointment Letter of person Operating USG Machine.
  2. Consent Letter of person Operating USG Machine with Timing.
  3. Registered Rent Agreement (Minimum 5 years).
  4. If Nursing Home, Registration under Nursing Home Act

(If applicable).

  1. (If partnership firm- Registered partnership agreement, Pvt. Ltd. Company, Article of Association and Memorandum of Association)

Bogus Doctor Finding And Action Committee

According to Government of Maharashtra from the government department of medical education and drugs CIM/1091/CR172/91MED-8 dated 5th September 1 99 1 at municipal corporation level committee was established. The Chairman of this committee is the Hon. Municipal Commissioner, Member secretary is Medical officer of Health, other member are Assistant Medical officer of health, Legal Expert, Information and public relations officer and Zonal medical officers.

A medical professional who is registered and whose renewal of registration done under : (any one of below mentioned councils)

  1. Maharashtra Medical Council (allopathy).
  2. Maharashtra Medical Council of Indian Medicine(Ayurveda, Unani & sidadha)
  3. Maharashtra Council of Homeopathy(Homoeopathy)
  4. Maharashtra Dental Council is called registered. Medical practioners.
